General Conditions of Sale (GCS)

GENERAL CONDITIONS OF SALE​​

Angels Com'Pawny is a protected trademark, registered with the INPI in September 2024.

 

Article 1 : Scope of application

These General Terms and Conditions of Sale (GTC) apply to all sales of commemorative items, such as urns, customizable jewelry and other associated products, made by ANGELS COM'PAWNY SAS, whose registered office is located at 3 Cours Gambetta, 34000 MONTPELLIER, registered under number 933 180 580 00013 (hereinafter "the Seller"), to any natural or legal person (hereinafter "the Customer").

By placing an order, the Customer unreservedly accepts these General Terms and Conditions.

Article 2 : Capacity of the buyer

By placing an order on the site, the Customer declares that they have the legal capacity necessary to enter into a commitment under these general terms and conditions of sale.

 

Article 3 : Product

The Seller offers customizable pet memorials (urns, jewelry, etc.) that the Customer can personalize according to their wishes via options available on the Seller's website.

The product photos presented on the website are for illustrative purposes only. The products delivered may vary slightly depending on the materials and customization chosen.

 

Article 4 : Order

Orders are placed directly via the website www.angels-compawny.fr, or by phone/email for specific requests. The Customer will receive an acknowledgment of receipt of their order, confirming that it has been processed.

The order is considered validated when the Customer has confirmed their choice of products and personalization and has made the total payment.

 

Article 5 : Price

Product prices are quoted in euros and include applicable VAT. The Seller reserves the right to change its prices at any time, but the applicable prices are those in effect at the time of the order.

Delivery costs are indicated when confirming the order and may vary depending on the delivery address.

The total amount due by the Customer is indicated on the order confirmation page.

 

Article 6 : Payment

Payment for products must be made when ordering by credit card, via Paypal or any other means offered on the Seller's website.

In the event of payment by credit card, the Customer guarantees that he or she is authorized to use this card. The Seller reserves the right to suspend or cancel any order in the event of refusal of payment authorization by banking organizations.

 

Article 7 : Personalization

The products offered by the Seller are customizable according to the Customer's specifications (engravings, inscriptions, etc.). The Customer is responsible for the accuracy of the information provided for personalization. In the event of an input error on the part of the Customer, the Seller cannot be held responsible for the consequences, including additional costs for modifying the products.

The Seller reserves the right to refuse any customization that is contrary to good morals or current legislation.

 

Article 8 : Delivery

The products are delivered to the address indicated by the Customer when ordering.

Delivery times vary depending on the nature of the products and the customization requested, and will be specified when ordering.

For the ballot boxes:

If the product is indicated as being in stock, ANGELS COM'PAWNY SAS undertakes to quickly process your order within 24 to 72 hours ( excluding Sundays and public holidays ) excluding customization times requiring an additional 24 to 72 hours.

For jewelry:

If the product is indicated as being in stock, ANGELS COM'PAWNY SAS undertakes to quickly process your order within 7 to 15 days ( excluding Sundays and public holidays ).

Delivery times are given for information purposes only. The Seller cannot be held responsible for delivery delays due to external events or malfunctions in transport services.

Package refused by the customer upon receipt:

If the customer refuses to accept their package, the shipping costs offered as well as the costs associated with returning the package to our workshop will be deducted from the amount to be refunded.

Stolen or lost package:

We are not responsible for packages stolen or lost after being reported as delivered by the carrier. No refunds or credits will be issued for packages confirmed as delivered by the carrier.

Incorrect delivery address:

It is the customer's responsibility to ensure that the delivery information entered is accurate before confirming and paying for their order. In the event of an error in the delivery address, we will not be able to issue any refunds or send a new order.

Article 9 : Withdrawal and return

In accordance with Article L.221-18 of the French Consumer Code, the Customer has a period of 14 calendar days from receipt of the order to exercise their right of withdrawal, provided that the products are not personalized. After this period, the return will be refused.

Any return request must be sent via the contact form .

Products returned incomplete (and in their original packaging), showing signs of wear or abnormal damage will not be accepted or refunded.

 For personalized products (engraved, inscribed, etc.), the right of withdrawal is excluded in accordance with article L.221-28 of the Consumer Code.

The shipping costs offered when ordering will be deducted from the amount to be refunded in the event of a product return. In addition, the cost of returning the package to our workshop remains the customer's responsibility.

Article 10 : Guarantees

The products are guaranteed against any manufacturing defects within the framework of the legal conditions of the legal guarantee of conformity and the guarantee against hidden defects. In the event of a proven defect, the Customer may request a replacement or a refund, according to the conditions provided for by the legislation in force.

Article 11 : Liability

The Seller shall not be held liable for any direct or indirect damages caused by the storage, use, or misuse of the products sold. The Seller's liability is limited to the amount of the order, in the event that liability is incurred.

 The Seller cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a breakdown in service, an external intrusion or the presence of computer viruses.

 

Article 12 : Protection of personal data

​ The personal information collected during the order is necessary for the management of the order. The Seller undertakes to respect the confidentiality of personal data and to process it in accordance with the legislation in force, in particular Regulation (EU) 2016/679 relating to data protection (GDPR).

 Data may be shared with service providers for order and delivery management, but under no circumstances will it be sold or shared for commercial purposes.

 

Article 13 : Intellectual property

All elements of the Seller's website (texts, images, logos, graphics, etc.) are protected by copyright and remain the exclusive property of the Seller. Any reproduction or use, even partial, of the elements present on the site is prohibited without the prior consent of the Seller.

 

Article 14 : Applicable law and disputes

 These General Terms and Conditions are governed by French law. In the event of a dispute, the Customer and the Seller undertake to seek an amicable solution. If this approach fails, the competent courts will be those of the Seller's registered office.

Article 15 : Modification of the T&Cs

The Seller reserves the right to modify its General Terms and Conditions at any time. The applicable General Terms and Conditions are those in effect at the time of the order.
